Terms of Service

These terms explain how bookings, memberships, packages and gift cards work at Vitality 4U, and what we each agree to so every visit is safe and relaxing. We've kept them as plain as we can. Please read them before you book.

1.About these terms

In these terms, "Vitality 4U", "we", "us" and "our" means Oceanside Gym Pty Ltd (ABN 33 646 380 314), trading as Vitality 4 U, of Unit 2/1 Arnold St, Cheltenham VIC 3192. "You" means the person booking or using our services.

By booking a session, buying a membership, package or gift card, or using our facilities, you agree to these terms. We take bookings and payments through Fresha, an online booking platform. Fresha's own terms also apply to your use of their platform.

2.Bookings

• You can book online through Fresha, by phone on 0429 697 075, or by emailing info@vitality4u.com.au. Online bookings are confirmed instantly.
• Session times are the time you have in the facility or treatment, so please arrive a few minutes early.
• If you arrive late, we may need to shorten your session so the next guest isn't delayed. The full price still applies.
• Group bookings and offers such as Two-Up Tuesday are subject to the details shown at the time of booking.

3.Cancellations and changes

Life happens. If you can't make it, please let us know as early as possible so we can offer your spot to someone else.

• The cancellation and no-show policy shown on our Fresha page when you book applies to your booking. You can cancel or reschedule through the Fresha app, or by contacting us.
• If we need to cancel or reschedule your session (for example because of a maintenance issue), we'll contact you as soon as we can and offer another time or a full refund for that session.

4.Prices and payment

• All prices are in Australian dollars and include GST where applicable.
• Payment is made through Fresha when you book, or in the venue. Card payments are processed securely by Fresha's payment providers. We don't store your card details.
• We may change our prices from time to time. The price shown when you book is the price you pay for that booking.
• Promotions and special offers run for a limited time, have the conditions shown with the offer, and can't be combined with other offers unless we say so.

5.Memberships

• Memberships are recurring. Your membership fee is charged in advance through Fresha and renews automatically each billing period until you cancel.
• What each membership includes (for example unlimited Elements access, and the number of premium sessions per week or month) is shown on our website and on Fresha when you join. Unused premium sessions don't roll over to the next period unless we say otherwise.
• You still need to book your sessions so we can manage numbers in the space.
• Memberships are for the named member only and can't be shared or transferred.
• To cancel, contact us or cancel through Fresha before your next billing date. Any minimum term or notice period is shown in the membership details on Fresha when you join.
• If an injury, illness or pregnancy stops you from using your membership, talk to us. We'll always try to help.

6.Packages and gift cards

• Session packages (such as 5 or 10 session bundles) are for the services listed in the package. Any expiry date is shown when you buy it.
• Gift cards are valid for at least three years from the date of purchase, as required by the Australian Consumer Law.
• Gift cards and packages can't be exchanged for cash, except where the law requires.

7.Health and safety

Heat, cold, pressure and light therapies are powerful. Most people enjoy every modality, but they're not right for everyone.

• Before your first visit we may ask you to complete a health questionnaire and sign a participation form. Please answer it honestly and tell us if anything changes.
• Don't use the facilities under the influence of alcohol or drugs.
• Listen to your body. Stay hydrated, build up gradually, and leave the sauna, cold plunge or any treatment straight away if you feel unwell, dizzy or uncomfortable.
• Please follow our team's instructions and any signs in the venue. We may limit, pause or refuse a session if we believe it isn't safe for you.
• Our services support general wellbeing and recovery. They aren't medical treatment and aren't a substitute for advice from your doctor or other health professional.

8.In the venue

• Bring your own towels, plus an extra one to sit on inside the Finnish sauna, and your swimwear.
• Please shower before using the spas and plunge tubs, and keep the space calm and respectful for everyone.
• Respect other guests' privacy. Don't photograph or film other people without their permission.
• Lockers are provided for your convenience. Please leave valuables at home where you can. We aren't responsible for lost or damaged belongings, except where caused by our negligence.
• We may ask anyone who behaves in an unsafe, offensive or disruptive way to leave.

9.Guests under 18

Guests under 18 need the consent of a parent or guardian and must be supervised by them during their visit. Some modalities may have minimum ages for safety reasons. Please ask us before booking.

10.Your consumer rights and our liability

Our services come with guarantees that can't be excluded under the Australian Consumer Law, including that they will be provided with due care and skill. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't lawfully be excluded.

Subject to those rights, and to the extent the law allows, we aren't liable for any loss that wasn't reasonably foreseeable, or that was caused by you not following these terms, our team's instructions, or medical advice.

If something isn't right, please tell us. We'd much rather fix it.

11.This website

• We work to keep the information on this site accurate and up to date. If anything differs, the details shown on Fresha at the time of booking apply.
• This site links to third-party sites such as Fresha, Instagram and Google Maps. We aren't responsible for their content or practices.
• The text, photos and branding on this site belong to Vitality 4U. Please don't reuse them without our permission.
• How we handle your personal information is explained in our Privacy Policy.

12.Changes and governing law

We may update these terms from time to time. The version on this page when you book applies to that booking. For memberships, we'll let you know about any significant change before it applies to you.

These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of Victoria.
